How It Works

Family Dispute Resolution is a structured process designed to assist parties to discuss issues, explore options, and work toward practical outcomes in a supported environment.

The process used by Umbrella Mediation is outlined below.

1. Initial Enquiry

The process begins when one party contacts Umbrella Mediation to make an enquiry. Information is provided about the mediation process, fees, and availability.

Where appropriate, an invitation can be issued to the other party to participate in Family Dispute Resolution.

2. Intake Appointments

Each party attends a private intake appointment, conducted separately. Intake appointments are confidential and allow the practitioner to:

  • understand the issues in dispute

  • assess suitability and safety

  • explain the mediation process

  • discuss next steps

3. Suitability and Preparation

Following intake appointments, the practitioner assesses whether Family Dispute Resolution is appropriate and what arrangements are required to support a safe and effective process.

If mediation proceeds, the issues to be discussed are clarified and a mediation session is scheduled.

4. Mediation Session

Mediation is conducted by Zoom or in person. Face-to-face mediations are available anywhere in Australia, subject to agreement.

The practitioner facilitates discussion between the parties, assists with communication, and supports exploration of options. The practitioner remains neutral and does not make decisions or provide legal advice.

5. Next Steps

If agreement is reached, outcomes are discussed and next steps are explained. If agreement is not reached, the practitioner will explain available options, including the circumstances in which a Section 60I certificate may be issued.
